Please read these Terms of Service carefully before placing an order with us. By accessing our website or purchasing from us, you agree to be bound by these terms.
1. About Us
The Final Act is operated by JE Future Wealth Pty Ltd as Trustee for JE Future Wealth Trust (ABN 96 678 506 228), trading as The Final Act. Our store is located at thefinalact.com.au.
2. Eligibility
By placing an order, you confirm that you are at least 18 years of age and are legally capable of entering into a binding contract in Australia.
3. Products
We curate a selection of luxury fragrances from some of the world's finest fragrance houses. All products are authentic and sourced through authorised channels. Product descriptions, including scent notes and fragrance families, are provided for informational purposes and are based on information supplied by the relevant fragrance house.
Fragrance is a subjective experience. We make no guarantee that a product will perform identically on every individual, as scent interaction varies with skin chemistry, climate, and other personal factors.
4. Pricing
All prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable. We reserve the right to change prices at any time without notice. The price you are charged is the price displayed at the time your order is placed.
5. Orders and Payment
By placing an order, you are making an offer to purchase. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, stock unavailability, or suspected fraudulent activity.
Payment is processed securely through Shopify Payments or other third-party payment processors. We do not store or have access to your full payment card details at any time.
Order confirmation does not constitute acceptance of your order. Acceptance occurs when your order is dispatched.
6. Shipping
We currently ship within Australia only. Shipping times and costs are displayed at checkout. Once your order has been dispatched, a tracking number will be provided where available.
We are not responsible for delays caused by Australia Post or third-party couriers, customs, natural events, or circumstances beyond our control.
Risk of loss and title for products passes to you upon delivery to the carrier.
7. Returns and Exchanges
Due to the nature of fragrance products, we do not accept returns or offer refunds once an order has been dispatched, except as required by Australian Consumer Law.
Exchanges are available subject to the following conditions:
- The request must be made within 14 days of delivery
- The product must be unused, in its original sealed packaging, and in resaleable condition
- You are responsible for return shipping costs
- Exchanges are subject to stock availability
To request an exchange, please contact us at hello@thefinalact.com.au with your order number and reason for the request.
Faulty or damaged goods: If your order arrives damaged or you receive an incorrect item, please contact us within 48 hours of delivery with photographic evidence. We will arrange a replacement or remedy in accordance with your rights under the Australian Consumer Law.
Nothing in these terms limits or excludes any rights you have under the Australian Consumer Law that cannot be excluded.
8. Intellectual Property
All content on this website — including text, images, logos, design, and code — is the property of The Final Act or its licensors and is protected by Australian and international copyright law. You may not reproduce, distribute, or use any content without our prior written consent.
9. Limitation of Liability
To the extent permitted by law, The Final Act's liability for any claim arising from your use of our website or purchase of our products is limited to the amount you paid for the relevant product. We are not liable for any indirect, incidental, or consequential loss or damage.
10. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Changes take effect from the date they are posted on this page. Continued use of our website constitutes acceptance of the updated Terms.
